TERMS AND CONDITIONS AND PRIVACY POLICY

Effective: 18 August 2023

This website (CompassPWS.com) is intended to identify potential participants for a clinical research study (COMPASS PWS) that is evaluating an investigational drug in study participants with Prader-Willi syndrome (PWS) who have hyperphagia. This website is hosted by Merge, LLC (“MERGE”), a third-party vendor under contract to the sponsor of the study (see below) and is not a sponsor of the study. “Us” or “We” means MERGE. “User” or “You” means those individuals who access the website. The sponsor of the study and this website is Acadia Pharmaceuticals Inc., a biopharmaceutical company headquartered in Sorrento Valley, San Diego, California.

Users of this website are provided criteria to consider as part of a self-assessment to determine if they may be eligible to participate in the COMPASS PWS study. Users who believe they may be eligible are offered to contact a listed research site for further information about possible participation in the study. Based on the User’s medical history, testing, and other information, the research site will make the final determination whether or not the User is qualified and approved to participate in the study. Meeting the requirements of the self-assessment, by itself, does NOT mean that a User is qualified and approved to participate in the study.

This website is provided for informational purposes only. Your use of the website does NOT create any legal relationship, whether by contract or otherwise, between Us or a research site and You, or the sponsor and You or another User. Your use of the website and decision to contact a listed research site is voluntary and without obligation.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE MAKE NO WARRANTIES REGARDING THE WEBSITE, THE ACCURACY AND COMPLETENESS OF THE INFORMATION CONTAINED THEREIN, AND ANY SERVICES PROVIDED. THEREFORE, THE WEBSITE, THE INFORMATION CONTAINED THEREIN AND ANY SERVICES ARE PROVIDED AND ACCEPTED BY USER “AS IS,” WITHOUT ANY WARRANTY WHATSOEVER. ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE, ARE SPECIFICALLY EXCLUDED AND DISCLAIMED. WE DO NOT WARRANT THAT THE WEBSITE, INFORMATION CONTAINED THEREIN, OR ANY SERVICES WILL MEET USER’S REQUIREMENTS, WILL OPERATE WITHOUT INTERRUPTION, WILL BE ERROR-FREE, COMPLETELY SECURE, OR THAT ANY FAILURES WILL BE DETECTED AND CORRECTED. WE SPECIFICALLY DISCLAIM AND DENY ANY RESPONSIBILITY FOR THE COMPLETENESS, ACCURACY OR QUALITY OF THE WEBSITE, INFORMATION CONTAINED THEREIN OR ANY SERVICES PROVIDED.

We exercise no control over, and accept no responsibility for, any third-party associated with the website, the information contained therein or any services provided, including but not limited to the listed research sites, which are independent contractors and outside of our management and control.

We shall not be liable to User, or any third parties, for any consequential, indirect, punitive, special, exemplary, or incidental damages or expenses, or damages or expenses of any kind arising from loss of anticipated profits, business interruption, loss of use, loss of revenue, corruption of data, loss of goodwill, cost of capital, loss or damage to property or equipment, and loss of reputation or any and all other similar damages or loss whether in contract, tort, product liability (including negligence or strict liability), or otherwise in connection with or arising out of the use of the website, the information contained therein and any services provided even if We are advised of the possibility of the occurrence of such damages or expenses.

Because Users do not register on the website or otherwise provide their names, no personal information of Users, such as name, address, telephone number or email address, is retained, collected or shared. Users consider the self-assessment criteria anonymously. The choice to contact a listed research site solely rests with the individual User, and the website does not provide any identifying or other information about a User to any research site or to another third party. We do not collect any information that would identify a User with the information.

The website may contain links to third parties, such as the research sites. We do not manage or control these third-party websites. If you provide personal information to these linked websites, this personal information is governed by their privacy policies and/or applicable law. We are not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use or reliance on any content, advertising, products, services or other materials on or available from these linked sites.

To ensure the smooth operation of the website and ensure its effectiveness, We collect certain limited analytics information (which does not include any personal or identifying information about Users) such as IP addresses, referring URL (if any), city-level location, browser and operating system and use analytics services such as Google Analytics, which use a set of cookies to collect information and report site usage statistics without personally identifying individual visitors, and which we will only use in accordance with applicable laws and regulations. You may opt out of the use of cookies by Google Analytics here. In addition, the website does not otherwise track Users who have selected the browser-based “Do-Not-Track” signals.

We employ physical, technical, and administrative procedures to safeguard the information that we collect. However, no website is 100% secure, and we cannot ensure or warrant the security of any information you transmit to the Services or to us, and you transmit such information at your own risk.

We do not knowingly collect or solicit personally identifiable information from Users, including children under thirteen (13) years of age.

We reserve the right to update or revise this Terms and Conditions and Privacy Policy at any time without prior notice. The most recent date this Terms and Conditions and Privacy Policy was revised is set forth above.

The website, information contained therein, any services provided, and this Terms of Conditions and Privacy Policy shall be governed by the laws of the State of North Carolina, without regard to its conflict of laws rules.
